General Terms and Conditions (GTC) for participation in the night flea market in front of the Rindermarkthalle St. Pauli
1. Booking and conclusion of contract
1.1 This offer is exclusively aimed at adults (18 years and older), hereinafter referred to as "Exhibitors".
1.2 By making a booking, the exhibitor accepts the applicable event conditions, in particular regarding setup times, participation requirements and allocation of space.
1.3 The booking becomes binding as soon as the full stand rental fee is received in the specified account within 5 working days. A separate payment confirmation will not be issued.
1.4 The information presented on the website does not constitute a binding offer. By clicking on "Book now", the exhibitor makes a binding offer within the meaning of § 145 BGB. The contract is concluded upon receipt of payment.
1.5 The language of the contract is German. All prices are final prices including any taxes. Payment is exclusively by advance payment.
1.6 The exhibitor is required to carry proof of payment (e.g. bank transfer receipt) on the day of the event in order to occupy the stand space.
2. Data protection
2.1 Personal data will be processed for contract fulfillment and – insofar as legally required – forwarded to authorities (e.g. the responsible regulatory authority).
2.2 After contract completion, data will be stored taking into account legal retention periods and subsequently deleted, unless further consent is given.
2.3 Exhibitors have the right to access, correct, block or delete their data at any time. The contact details can be found in the imprint.
3. No right of withdrawal
3.1 According to § 312g paragraph 2 number 9 BGB (German Civil Code), there is no right of withdrawal for contracts for the provision of services in connection with leisure activities if a specific date has been agreed upon.
3.2 Booking a pitch constitutes a fixed-date contract. Therefore, a statutory right of withdrawal is excluded.
4. Voluntary cancellation option
4.1 Regardless of the statutory exclusion of the right of withdrawal, the organizer offers free cancellation up to 14 calendar days before the event date. In this case, the paid stand rental fee will be fully refunded.
4.2 Cancellation must be made in writing by e-mail to the address stated in the imprint. The exhibitor bears the burden of proof for timely receipt.
4.3 The organizer reserves the right to cancel bookings without giving reasons. In this case, a full refund of the paid stand rental fee will be made.
5. On the day of the event
5.1 Participation in and entry to the market area are at your own risk.
5.2 The event will take place in all weather conditions.
5.3 Stalls are marked and numbered. The booked stall must be claimed on site with proof of booking and payment.
5.4 If the exhibitor does not arrive by 6:00 PM at the latest, the space may be re-assigned without any claim to a refund.
5.5 The organizer reserves the right to rearrange booked stalls if necessary, in order to ensure a harmonious overall image of the market.
5.6 Market stalls, clothes racks or tables provided by the organizer, if any, are provided without guarantee of stability, completeness or weather protection. The exhibitor is responsible for checking their weather resistance. In particular, in strong wind or rain, setup and use are at the exhibitor's own risk. The organizer assumes no liability for resulting damage to persons or property – even in cases of simple negligence. Liability is limited to cases of intentional or grossly negligent conduct.
6. Force Majeure and Event Cancellation
6.1 In the event of cancellation of the event due to force majeure (e.g. severe weather, official orders, pandemics, security risks, strikes), there is no entitlement to a refund of the stand rental or other costs.
6.2 In such cases, the exhibitor bears the economic risk. Further claims, in particular for damages or lost profits, are excluded.
6.3 Unless otherwise expressly agreed, the statutory warranty provisions (§§ 433 et seq. BGB) shall apply. Set-off is only permitted with undisputed or legally established claims.
7. Liability
7.1 The organizer is not liable for damage to persons, objects or goods, nor for theft, loss or damage during the event.
7.2 The exhibitor is liable for all damage caused by him or his assistants. He indemnifies the organizer against claims by third parties.
8. Conduct and obligations of the exhibitors
8.1 Only the sale of used private goods is permitted. The sale of new goods, food, Nazi symbols, or content that is harmful to minors or discriminatory is strictly prohibited.
8.2 For safety reasons, setting up tents, pavilions or large parasols is not permitted.
8.3 Traffic, rescue and escape routes must always be kept clear.
8.4 The stand must remain open until the official end of the event. Exceptions due to extreme weather conditions may be permitted by the organizer.
8.5 The exhibitor undertakes to leave their stand clean and to dispose of all waste independently. In case of significant soiling or damage, cleaning costs or compensation may be claimed.
8.6 In case of serious or repeated violations of the Terms and Conditions or market rules, the exhibitor may be excluded from participation without a refund.
8.7 Playing music at the booth is only permitted if the exhibitor has properly registered it with GEMA. The organizer assumes no responsibility for this.
9. Content and External Links
9.1 The organizer assumes no liability for the content of external websites to which links are provided. The operators of those websites are solely responsible for their content.
10. Copyright
10.1 The content of this website is subject to German copyright law. Reproduction, processing or distribution requires written consent. Downloads are permitted only for private use.
11. Online dispute resolution
11.1 The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr/ .
12. Severability Clause
12.1 Should individual provisions of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The statutory provision shall apply in their place.
